1. Acceptance of Terms

By accessing or using Gumptious ("the Platform", "we", "our", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Platform.

2. Description of Service

Gumptious provides an embeddable viral giveaway and contest management platform. Features include referral tracking, video verification, user-generated content collection, and campaign analytics. Services are provided on a credit-based or subscription basis.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at admin@gumptious.net of any unauthorized use.

4. Acceptable Use

You agree NOT to use Gumptious to:

  • Run fraudulent, misleading, or deceptive giveaways
  • Collect data from minors under 13 without verified parental consent
  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of third parties
  • Distribute malware, spam, or unsolicited commercial messages
  • Attempt to reverse-engineer or circumvent the Platform's security measures

5. Credits & Subscriptions

Gumptious operates on a credit-based and subscription model. Credits are non-refundable once a campaign has been launched. Subscription plans auto-renew unless cancelled at least 24 hours before the renewal date. Lifetime plans are a one-time purchase with no recurring fees.

6. User-Generated Content

By uploading content to the Platform, you grant Gumptious a non-exclusive, worldwide, royalty-free license to display and process your content solely for the purpose of operating the giveaway campaign. You retain ownership of all content you upload. You are solely responsible for ensuring you have the rights to any content submitted.

7. Intellectual Property

The Gumptious name, logo, platform design, and underlying software are the exclusive property of Gumptious and are protected by applicable intellectual property laws. You may not use our branding without express written permission.

8. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Gumptious shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved exclusively in the courts of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms. Material changes will be communicated via email to your registered address.
